These Terms & Conditions apply to the Kwiqr mobile application (the “App”) and the website www.kwiqr.uk (together, the “Platform”).
The Platform is operated by Special Apps of Granary Barn, Orchard Park Farm, Lurgashall, GU28 9EU (referred to as “Kwiqr”, “we”, “us”, or “our”).

By downloading, accessing, browsing, or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who these Terms apply to
These Terms apply to:
• Participants/Users who browse events, create accounts, book activities, or sign documents; and
• Organisers (clubs, venues, promoters, businesses, schools, or other providers) who list events/activities and use the organiser tools/portal.
Some sections apply specifically to Organisers and are labelled.

2. What Kwiqr does (and does not do)
Kwiqr provides a digital platform to help Organisers manage:
• event/activity listings,
• bookings and entries,
• digital sign-on, declarations and waivers,
• check-in (including QR codes/wristbands where available),
• communications and administration.
Kwiqr is not the organiser or provider of the activity/event unless we clearly state otherwise. The Organiser is responsible for:
• running the event/activity,
• safety, supervision, and risk assessments,
• permissions, licences, permits, insurance, and compliance,
• event rules/class eligibility and technical checks,
• refunds/cancellations (unless Kwiqr explicitly handles these on their behalf).
Any contract for an event/activity is typically between you and the Organiser. Kwiqr is a technology provider and intermediary.

3. Eligibility, accounts, and accurate information
3.1 Age and safeguarding
You must be at least 13 years old to use the Platform unless your parent/guardian creates and manages the account for you (or as otherwise required by law). Some events/activities may require you to be 18+.
If you are booking/signing on for a child, you confirm you have the legal authority to do so.
3.2 Account security
You are responsible for:
• keeping your login details confidential,
• all activity carried out under your account,
• ensuring your device is secure.
Notify us immediately if you suspect unauthorised use.
3.3 Accurate details
You must ensure information you provide is accurate and up to date (e.g., name, date of birth, emergency contact, licence/membership numbers, vehicle/bike details, etc.). Organisers may rely on your information for eligibility and safety.

4. Digital sign-on, declarations and waivers
Where the Platform enables digital sign-on:
• You agree that ticking boxes, typing your name, applying a digital signature, or completing a digital declaration creates a legally binding acknowledgement (subject to applicable law).
• You must read each declaration/waiver carefully before signing.
• Organisers control the wording and requirements of their declarations/waivers. Kwiqr may store and present them, but the Organiser is responsible for their content and suitability.
Nothing in these Terms excludes liability that cannot be excluded by law, including (in the UK) liability for death or personal injury caused by negligence.

5. Bookings, entries, payments and fees
5.1 Prices and fees
Event prices, entry fees, membership fees, add-ons (e.g., one-event licences), and any booking fees are shown at checkout (or on the event page). Some services may be Freemium (free with optional paid upgrades).
5.2 Payments
Payments may be processed by third-party payment providers and/or app store payment systems (Apple/Google). Your payment may appear on your statement under the relevant provider.
5.3 Refunds and cancellations (Users)
Refund eligibility depends on:
• the Organiser’s refund policy (shown on the event page or at checkout), and/or
• the terms of the payment provider/app store.
If an event is cancelled, postponed, or changed, the Organiser is responsible for communicating outcomes and applying their policy (unless Kwiqr explicitly states it is managing refunds for that event).
5.4 Refunds and cancellations (Organisers)
Organisers are responsible for:
• publishing accurate refund/cancellation policies,
• applying them fairly and in line with consumer law,
• processing refunds where required, unless a Kwiqr feature explicitly automates this.

6. Event rules, eligibility, and organiser decisions
Organisers may set eligibility rules including (example):
• age groups,
• licence/membership requirements,
• class definitions,
• technical limits (e.g., wheel sizes, power limits),
• safety gear requirements.
Organisers may refuse entry or remove participants for safety, rule breaches, or misconduct. Kwiqr is not responsible for these decisions.

7. Location services, device permissions, and internet access
Some features require access to device services (e.g., camera for QR scanning, notifications, storage). You can control permissions in your device settings, but some features may not work without them.
The Platform may require an active internet connection. You are responsible for any mobile data or roaming charges.

8. Prohibited use
You agree not to:
• copy, modify, reverse engineer, decompile, or attempt to extract source code from the Platform,
• create derivative works, resell access, or misuse the Platform,
• misuse QR codes, tickets, wristbands, sign-on, or identity checks,
• upload viruses, malicious code, or attempt to disrupt the Platform,
• use the Platform unlawfully or to harass, defraud, or impersonate others.
Jailbreaking/rooting your device may compromise security and cause the App to malfunction. Use of the App on a jailbroken/rooted device is at your own risk.

9. User content and organiser content
You (or Organisers) may upload content such as event details, images, logos, documents, rules, waivers, and messages.
You warrant that you have the rights to upload and use that content and it does not infringe third-party rights.
Kwiqr may remove or restrict content that violates these Terms or applicable law.

10. Third-party services
The Platform may integrate third-party services (e.g., analytics, crash reporting, push notifications, payments, advertising, login). These services may have their own terms and privacy policies.
Replace this list with the services you actually use (delete anything not used):
• Google Play Services
• Apple App Store / StoreKit (for iOS purchases)
• Google Analytics for Firebase
• Firebase Crashlytics
• OneSignal (push notifications)
• RevenueCat (subscriptions/in-app purchases)

11. Privacy and data protection
We store and process personal data to operate the Platform and provide services.

If you are an Organiser, you are responsible for complying with data protection laws for the participant data you collect and process via the Platform.

12. Safety disclaimer
Activities listed on Kwiqr may involve risk (e.g., motorsport, cycling, outdoor activities). You are responsible for:
• assessing your own ability and fitness,
• using appropriate protective equipment,
• following Organiser instructions and venue rules.
Organisers are responsible for event safety management, staffing, medical provision (where applicable), and compliance.

13. Availability, updates, and changes
We aim to keep the Platform available and up to date but do not guarantee uninterrupted access. We may:
• update, change, suspend, or withdraw features,
• fix bugs and release updates,
• change pricing for paid features (we will show pricing clearly before you pay).
You agree to accept updates when offered (where required for continued use).

14. Termination
We may suspend or terminate your account and access to the Platform if:
• you breach these Terms,
• we reasonably suspect fraud, misuse, or unlawful activity,
• required by law or to protect users/Organisers.
You may stop using the Platform at any time and remove the App from your device.

15. Liability
Nothing in these Terms limits or excludes liability that cannot be excluded by law (including, in the UK, liability for death or personal injury caused by negligence, or fraud).
Subject to that:
• We are not liable for losses caused by events or services provided by Organisers, including cancellations, injuries, disputes, or rule decisions.
• We are not liable for indirect or consequential losses (e.g., loss of profits, loss of business, loss of goodwill).
• Our total liability to you for claims related to the Platform is limited to the greater of: (a) the amount you paid to Kwiqr for the Platform in the 12 months before the claim, or (b) £100, unless a higher amount is required by law.

16. Indemnity (Organisers and Users)
If you breach these Terms and that causes loss or claims against Kwiqr, you agree to indemnify us for reasonable costs and losses arising from that breach (including legal costs where permitted by law).

17. Consumer rights
If you are a consumer in the UK, you have legal rights under consumer protection laws (including the Consumer Rights Act 2015). Nothing in these Terms affects those rights.

18. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where consumer law in your country requires otherwise.

19. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on the Platform and update the “Last updated” date. If changes are material, we may also notify you in-app or by email.

20. App Store refund requests (Apple/Google)
If you request a refund through Apple or Google (where applicable), we may share relevant account and usage/consumption data with the app store provider to help them assess your request, in line with our Privacy Policy and the provider’s requirements.
